A strip of an approved subdivision was condemned for construction of a new highway. Road construction before and after the condemnation led to acid rock drainage pollution. Mike Faherty presented Board of View evidence of pollution of the remainder property. The case settled before trial for over eighteen times the estimated just compensation.


Mike Faherty recently settled a case with nine property owners whose land was condemned by a natural gas company per the authorization of the Federal Energy Regulatory Commission. The condemnation in federal court initially sought the right to store natural gas and condemn layers of Marcellus Shale. All nine cases favorably settled during the discovery phase in anticipation of trial.


Mike Faherty recently negotiated the sale of property rights of three neighbors to a company which develops shopping centers. The company, without the power of eminent domain, sought land to widen the road to satisfy municipal traffic demands. Reduced property rights were negotiated and settlement values were several times over the offered amounts.
